On December 7, 2017,Professor Dr. Erik Hahn gave a presentation on“Telemedicine and the Ban on Remote Treatment”at the 14th National Congress of the German Society for Integrated Healthcare (Deutsche Gesellschaft für Integrierte Versorgung im Gesundheitswesen e. V.). The conference took place at the “Auditorium Friedrichstraße” in Berlin and was attended by a wide range of stakeholders from the healthcare industry.
In his presentation, Professor Hahn discussed the legal framework for remote treatment from a German perspective (professional regulations, laws governing the advertising of therapeutic products, and pharmaceutical law). He provided information about the increase in foreign players in this sector who—such as British online doctors and Dutch mail-order pharmacies—provide e-health services on the German healthcare market as well, based on European fundamental freedoms. The lack of consistency in health law—evident, for example, in the liberalization of medical professional law coupled with the simultaneous tightening of pharmaceutical law—was another key focus of the presentation.
The German Society for Integrated Healthcare (Deutsche Gesellschaft für Integrierte Versorgung im Gesundheitswesen e. V.) is a nationwide association dedicated to promoting cross-sectoral care through medical, nursing, and social achievements. In particular, it seeks to break down or make more permeable the boundaries between outpatient and inpatient care, as well as to foster closer collaboration between private practice providers and the hospital sector. Telemedicine applications can help achieve this goal and, at the same time, make an important contribution to ensuring access to care in structurally disadvantaged areas. Other speakers at the conference included Dr. Andreas Gassen, Chairman of the Board of the National Association of Statutory Health Insurance Physicians; Cornelia Prüfer-Storcks, Hamburg’s Senator for Health and Consumer Protection; and Prof. Dr. Günter Neubauer, Director of the Munich Institute for Health Economics.
In addition to the lecture program, the event provided a good opportunity to establish new contacts or further strengthen existing ones with various professional associations, ministries, and medical device manufacturers, thereby also strengthening the e-health research area (Prof. Dr. Hahn, Zittau & Institute for Health, Ageing, and Technology – GAT, Görlitz). On this basis, future transfer projects can be developed, and practice-oriented final dissertations can be offered to students in the fields of “International Business Law” and “Medical Law.”
